David Platt QC will give a presentation about how tactics and techniques used in disease litigation can be deployed in health & safety work. David practices in both areas and will discuss how concepts of risk, reasonable practicability and medical causation can be employed in the defence of criminal prosecutions. How do you define “risk” and what is the role of epidemiology in its assessment? How can expert engineering and medical opinion be better deployed in criminal cases?
The increasing tendency of regulatory authorities to prosecute in disease cases will also be considered (whether that be involving asbestos, vibration claims or deafness). David will also discuss the recent decision in Goldscheider v Royal Opera House and what this could mean for regulatory intervention in the music and entertainment industry.
