Law Society issues Judicial Review of Criminal Defence Costs Regulation

The Law Society has announced its intention to Judicially Review the Government's recent introduction of the Costs in Criminal Cases (Amendment) Regulations 2009.

The Regulations limit a successful Defendant's costs to legal aid rates, leaving a significant shortfall between recoverable costs and those actually incurred by the successful party.

UPDATE: The Law Society issued an application for Judicial Review on 7 January 2010 after receiving an unsatisfactory response from the Government. After approximately 6-8 weeks, the Administrative Court will decide whether or not to grant permission to proceed. If the Law Society is granted permission, the matter will come on for final hearing around April/May 2010.

Our Chair provided evidence to support the Application.
